Background & Purpose

There has been a need for clearer rules regarding how authorities can monitor individuals who are part of the migration process. The goal is to create more alternatives to detention while ensuring better control.

The Decision

The Swedish Parliament voted yes to new rules for supervision, including electronic monitoring, which will mainly take effect on July 21, 2026. However, the Parliament decided to pause specific proposals regarding the detention of children, time limits for children in detention, and the separation of children from their guardians for at least twelve months.

Does this affect you?

  • People in the migration process: Individuals who are waiting for a decision on their residency status may be placed under stricter supervision or electronic monitoring instead of being detained.
  • Migration authorities: Staff at agencies like the Swedish Migration Agency will have clearer legal guidelines on when and how they can use supervision or detention.

In Practice

  • Authorities can now use more forms of supervision as an alternative to locking someone up in detention.
  • Supervision may include requirements to live in a specific place or stay within a certain area.
  • Electronic monitoring can be used to ensure that a person follows the rules of their supervision.
  • It will be clearer which government agency is responsible for making decisions about supervision and detention at different stages of the process.
